Hot Checks

     The Lubbock County District Attorney's Office accepts hot checks from merchants and files charges against hot check writers. Depending of the amount on the checks and the severity of the case, they may file felony or misdemeanor charges. In most instances, the class "C" misdemeanor charge for Issuance of a Bad Check is filed in Justice of the Peace Court.

     If you know you have hot checks, or you suspect you may have had some checks turned in, contact the District Attorney Hot Check office at 775-1111. Their office is located at 904 Broadway on the 1st floor of the Lubbock County Courthouse. You may wish to come in and inspect the checks at the check office. You should always go to the check office to discuss your situation and view the checks in question.

     If you know you are the person who wrote the checks in question, you will still need to go to the check office to make arrangements to pay off your checks before you go to the J.P. Court.

     On this offense, you have the absolute right to plead Not Guilty and request a trial. If you choose to go to trial, you will need to post an appearance bond. An appearance bond simply means you are putting up collateral (usually cash or surety) to guarantee your appearance in Court. Once you show up for your trial, the bond will be returned to you.

     If you wish to plead Not Guilty, you may also request trial by Judge or Jury. That choice is yours.  You are not required to have an attorney in Court, but you may hire one if you wish. The District Attorney of Lubbock County will have an attorney present to prosecute the case against you. The Judge is prohibited, by Law, from discussing your case with you unless you have pled guilty or no contest, or the District Attorney is also present.

     If you choose to go to Court, you are responsible for bringing all papers, pictures, and exhibits with you to the Court hearing. You may also contact the Court for information on how to subpoena witnesses.
